3- Indirect Intent in the Context of Unlawful Conduct
From a legal perspective, any act constitutes a crime when it fulfills three elements: the legal element, the material element, and the moral element. The moral element is achieved through the actual knowledge of committing an unlawful act, with the knowledge that it leads to prohibited results. This constitutes direct intent as defined by Ibn Hazm. However, acts whose consequences are unforeseen are addressed by the legislator under indirect intent, especially when the severity of the crime leads to a serious legal liability.Additionally, indirect intent is based on the principle of "indifference," where the perpetrator commits the act without regard for its consequences or the harm it may cause. Indirect intent often pertains to harmful behaviors that aim to achieve unlawful purposes, such as intentional neglect of treating diseases or requesting arbitrary measures for consuming prohibited substances.
