بوعلام: أعترف بوجود ملفات وفيديوهات لكنها تندرج ضمن حرية التعبير عن الرأي
🛑أقرّ الكاتب بوعلام صنصال أمام القضاء الجزائري بحيازته ملفات وفيديوهات تمس النظام العام وأمن الجزائر، لكنه تحجج بأنها كانت “في إطار حرية التعبير عن الرأي لا أكثر”، ولم يجد الكاتب المتهم مفرّا من الاعتراف لهيئة المحكمة بأنه تبادل رسائل مع سفيرين فرنسيين، وحين واجهه القاضي بحقيقة تلك المراسلات، حاول التبرير قائلا: “إنهما مجرد صديقين”!.. تابعوا تفاصيل المحاكمة..
مع تمام الساعة العاشرة صباحا من يوم الخميس 20 مارس الجاري.. دخل بوعلام صنصال إلى قاعة الجلسات غير مكبل اليدين… وبكل أريحية وبخطى واثقة، حيث بدا هادئا، دون أن تظهر عليه أي علامات إرهاق أو تدهور صحي، خلافًا لما روجته بعض الأطراف.. فقد بدا الرجل في حالة صحة جيدة.. لم يكن هناك أي ارتباك في حركته أو ملامحه، بل بدا في وضع طبيعي، مرتديا لباسا بسيطا يعكس راحته الجسدية، ما أكد أنه لم يتعرض لأي سوء معاملة أو ضغط خلال فترة توقيفه، وزاد في ذلك تلك المعاملة الإنسانية التي تلقاها سواء من أعوان الحراسة أم من تشكيلة هيئة المحكمة.
🛑وفي القاعة رقم 2 لمحكمة الدار البيضاء بالجزائر العاصمة، خلال جلسة روتينية عادية جدا لقضايا النظام العام وما يليها من جنح ومخالفات، كان صنصال رابع المتهمين الذين مثلوا أمام هيئة المحكمة، مما يؤكد أنه كباقي المتهمين لا تسبيق ولا تفضيل من حيث إجراءات المحاكمة العادلة.
…عشرون دقيقة فقط كانت كافية ليدحر القضاء الجزائري زيف الادعاءات المسمومة التي حاول بعض الحاقدين على الجزائر تسويقها عن ضغوط مزعومة وتعذيب مختلق، فالجزائر دولة بأركانها ومؤسساتها السيادية تحاكم بالمرافعة وليس بالانتقام وترفع راية الحق فوق كل اعتبار.
القاضي ينادي على بوعلام صنصال ويطلب منه أن يتقدم إلى المكان المخصص للاستجواب، ويسأله هل أنت مستعد للمحاكمة؟
أين هو دفاعك؟ ليرد عليه الروائي: قررت إلغاء توكيل محامي الدفاع، وأنا مستعد للإجابة عن جميع الأسئلة التي تطرحها علي هيئة المحكمة.
القاضي يشرع في المحاكمة ويواجه صنصال بالتهم التي وجهها إليه قاضي التحقيق، بينما بدا هذا الأخير غير متوتر أو مضطرب، بل كان يستمع بتركيز إلى ما يقوله القاضي، وإن كان يضطر في بعض الأحيان إلى الاقتراب منه بسبب معاناته من نقص السمع، هذا التفاعل كان واضحا طوال الجلسة، حيث كان المتهم يتقدم خطوة للأمام كلما احتاج إلى سماع السؤال بوضوح، بينما تعامل القاضي معه بصبر، مكررا بعض العبارات لتوضيح الأسئلة المطروحة.
ورغم ثقل التهم التي يواجهها، لم يحاول صنصال التهرب من الإجابة، بل كان يرد بشكل مباشر وواضح، متحدثا بلهجة هادئة بعيدا عن الانفعال، فيما تميزت الجلسة بالسلاسة، حيث لم يتم تسجيل أي توتر أو مشاحنات، بل سارت في إطار قانوني منضبط، كما أن المحكمة لم تفرض عليه أي قيود، ما يعكس احترام الإجراءات القانونية وضمان حقوق المتهم في الدفاع عن نفسه بحرية تامة.
بدا صنصال في وضع مريح، حتى إنه أظهر بعض الإيماءات التي تعكس ثقته في حديثه، ولم يتردد في طلب توضيح بعض الأسئلة قبل الإجابة عليها بسبب مشكل اللغة، ورغم رفضه تأسيس أي محامي للدفاع عنه، لم يكن هناك أي ضغط عليه، بل سمح له بالتعبير عن وجهة نظره دون مقاطعة أو تضييق، من قبل هيئة المحكمة التي تعاملت معه بمهنية واحترام تام لحقوق المتقاضي، متيحة له فرصة الرد الكامل على كل التهم المنسوبة إليه.
استمرت الجلسة في أجواء طبيعية، حيث بدا صنصال مدركا لما يجري حوله، متجاوبا مع مجريات المحاكمة، ولم يُظهر أي علامات توتر أو اضطراب، وبذلك، مرت وقائع المحاكمة وسط احترام صارم للإجراءات القانونية، مما يؤكد أن الجلسة جرت في إطار عادل ومنصف، منح المتهم فرصة كاملة للدفاع عن نفسه دون أي عراقيل أو ضغوطات.
وجها لوجه.. القاضي يستجوب صنصال
القاضي ودون إطالة يشرع في استجواب المتهم بوعلام صنصال.
القاضي: هل تتحدث العربية؟
صنصال: سيدي الرئيس بصراحة لا أتقنها.
القاضي: ماذا عن “الدارجة”؟ سنتحدث “بالدارجة”، حاول أن ترد حسب استطاعتك ومقدورك في فهم الأسئلة الموجهة إليك.
المتهم: لا أفهم العامية أيضا سيدي الرئيس.
القاضي يسأل صنصال عن اسمه الكامل، ويتأكد من هويته وتاريخ ميلاده ومعلوماته الشخصية، ثم يوجه إليه التهم المنسوبة إليه، أنت متابع بجنح المساس بالوحدة الوطنية، إهانة هيئة نظامية، القيام بممارسات من شأنها الإضرار بالأمن والاقتصاد الوطني، حيازة مقاطع فيديو تهدد الأمن الوطني هل تعترف أم تنكر؟
صنصال: لا سيدي الرئيس أنكر هذه التهم جملة وتفصيلا.
القاضي: أسفر التفتيش الإلكتروني لأجهزتك، بما في ذلك الهاتف النقال، عن العثور على رسالة موجهة إلى شخص يدعى “يزيد”، ينتمي إلى حركة “الماك”، تخبره فيها بأنك سعيد بما يقوم به التنظيم لتحقيق الاستقلال وانفصال منطقة القبائل، هل فعلا أرسلت له ذلك وما هو ردك بخصوص هذه الوقائع؟
صنصال: لا لم أقم بإرسالها له سيدي الرئيس.
القاضي: هناك تهمة أخرى تتعلق بإهانة هيئة نظامية، وتحديدا البرلمان الجزائري، حيث تم العثور على رسائل بينك وبين أحد أعضاء السفارة الفرنسية.
صنصال:” j’ai pas compris ” لم أفهم ؟ “.
القاضي يوضح: هناك رسائل عبر واتساب بينك وبين السفير الفرنسي الحالي تتضمن إهانة للجيش والمؤسسات الحكومية؟
صنصال: نعم، لا أنكر وجود هذه الرسائل، لكنها كانت مجرد محادثة عادية ولم تتضمن أي إهانة.
القاضي: سؤال آخر، وفقا لنتائج التفتيش الإلكتروني، تم العثور على رسائل بينك وبين السفير الفرنسي السابق بالجزائر، حيث عبرت عن سعادتك بالوضع الحالي في الجزائر وقلت له: “أنا فرحان نحن نملك البترول وشنقريحة” ماذا تقصد بذلك؟
صنصال: نعم كانت هناك رسائل بيننا، فنحن أصدقاء، وقد عبرت له فيها عن حقيقة الوضع المالي والأمني في الجزائر، والتعبير عن سعادتي بالوضع الأمني والمالي المستقر الذي تعيشه بلادنا، ولا يتضمن أي إهانة أو استهزاء، ولم تكن لدي أي نية سيئة من وراء هذه الرسائل.
القاضي: ماذا عن المقال الذي تم العثور عليه بحوزتك، والذي يتناول موضوع القوة العسكرية في الجزائر والجيش؟
صنصال: كنت أعبر عن رأيي كمواطن جزائري، وكتبت المقال لطرح وجهة نظري دون أي نية للإساءة إلى مؤسسة الجيش التي أحترمها كثيرا.
القاضي: هناك تهمة أخرى تتعلق بالمساس بالاقتصاد الوطني، بناء على تفتيش هاتفك واسترجاع رسائل ومحادثات شخصية مع السفير الفرنسي السابق، حيث تحدثت عن قرارات رفض انضمام الجزائر إلى منظمة “بريكس” مرتين.
صنصال: هذه الرسائل كانت مجرد محادثة بيني وبين السفير، تجمعنا علاقة صداقة وليس بحكم منصبه كدبلوماسي فرنسي.
القاضي: ما ردك على تهمة الترويج لأخبار كاذبة تمس أمن الجزائر، وذلك من خلال مقابلة تلفزيونية انتقدت فيها قرارات الدولة ومؤسساتها بناء على معلومات غير صحيحة ونسبت لها وقائع لا أساس لها؟
صنصال: المقابلة التي نشرتها لاحقا على المواقع الإلكترونية جاءت فيها تصريحات تعبير عن رأيي وانشغالي كمواطن جزائري، وحاولت نقل الواقع الذي أعيشه مثل بقية الجزائريين، لم تكن هناك أي نية للإساءة بطبيعة الحال.
القاضي: أنت متهم أيضا بحيازة مستندات ومقاطع فيديو، تم العثور عليها في الذاكرة الوميضية الخاصة بك، والتي تمس بالنظام العام وأمن البلاد، ما تعليقك؟.
صنصال: نعم، أعترف بوجود هذه الملفات والفيديوهات، لكنني أنشأتها في إطار حرية التعبير عن الرأي لا أكثر.
10 سنوات حبسا نافذة بتهم المساس بوحدة الوطن
وفي ضوء ذلك، التمس وكيل الجمهورية لدى محكمة الجنح بالدار البيضاء في العاصمة، توقيع عقوبة 10 سنوات حبسا نافذا وغرامة مالية قدرها مليون دينار جزائري بحق المدعو صنصال بوعلام، عن بتهم المساس بوحدة الوطن، إهانة هيئة نظامية، القيام بممارسات من شأنها الإضرار بالاقتصاد الوطني، وحيازة فيديوهات ومنشورات تهدد الأمن والاستقرار الوطني.
وفي مرافعة قوية لوكيل الجمهورية، أكد أن المتهم صنصال بوعلام، وهو مواطن جزائري يحمل الجنسية الجزائرية، كان يشغل منصبا حكوميا هاما في إحدى أقل الوزارات، إلا أنه تورط في تصريحات ومنشورات تمس بالوحدة الوطنية وتهدد أمن واستقرار البلاد.
وخاض ممثل الحق العام خلال مرافعته في تفاصيل توقيفه في مطار هواري بومدين في أثناء دخوله إلى أرض الوطن بجواز سفر جزائري، بناء على أمر توقيف صادر بحقه، وإلقاء القبض عليه بمطار جزائري، حسب ما أشار إليه النائب العام.
وكشف النائب العام أن عمليات التفتيش الإلكتروني التي أجريت على هاتف المتهم وحاسوبه ووسائط التخزين الخاصة به، أسفرت عن العثور على ملفات ومقاطع فيديو، إلى جانب رسائل متبادلة عبر تطبيق “واتساب”، تتضمن مضامين خطيرة تمس بالأمن الوطني، مبرزا أن التحقيقات الأمنية كشفت عن تصريحات صحفية أدلى بها المتهم، تضمنت محتوى يمس بالوحدة الترابية للوطن.
كما أظهرت التحريات يضيف وكيل الجمهورية ـ وجود رسائل متبادلة بينه وبين أعضاء في التنظيم الإرهابي “الماك”، حيث اعترف المتهم بعلاقته بشخص يدعى “يزيد”، وهو أحد أعضاء التنظيم، تطرق فيها إلى مسألة انفصال منطقة القبائل، بالإضافة إلى مناقشة مخططات التنظيم لتحقيق هذا الهدف.
واتهمت النيابة المتهم بتوجيه إهانات صريحة لهيئات نظامية في الجزائر، وذلك عبر مجموعة من الرسائل التي حملت عبارات تمس بشخصيات جزائرية، وتضمنت اتهامات لا أساس لها من الصحة، فضلا عن نشر أفكار ومزاعم مغلوطة.
كما أكد وكيل الجمهورية أن المتهم، الذي كان يشغل منصبا ساميا في أحد القطاعات الحساسة، قام خلال شهر أكتوبر الماضي بتوجيه رسائل تتضمن انتقادات لاذعة للاقتصاد الوطني، مستخدما عبارات تهدف إلى التشكيك في أداء المؤسسات الدستورية والمدنية والعسكرية للدولة الجزائرية.
وأوضح أن عملية تفتيش الذاكرة الوميضية الخاصة بالمتهم أسفرت عن العثور على مستندات حساسة من شأنها الإضرار بالمصلحة الوطنية، كما شددت النيابة على أن المتهم، رغم تمتعه بحق التعبير عن رأيه بحرية والذي صرح خلال استجوابه أنه تكلم في إطار حرية التعبير عن الرأي مثله مثل أي جزائري، إلا أن القانون والدستور الجزائري، إلى جانب قانون العقوبات وقانون الإجراءات الجزائية، يضعان ضوابط صارمة لممارسة هذا الحق، ولا يمكن تجاوزه تحت أي ذريعة.
نشر مقالات وتصريحات ضد الدولة في الصحافة الأجنبية
وإلى ذلك، أشار وكيل الجمهورية أن المتهم نشر العديد من المقالات في صحف أجنبية، وظهر في عدة حوارات صحفية، أدلى خلالها بتصريحات تتضمن إساءة مباشرة للوحدة الوطنية، كما أقرّ المتهم خلال التحقيقات بمسؤوليته عن نشر هذه التصريحات، متحججا بحرية التعبير، وهو ما اعتبرته النيابة ذريعة واهية لتبرير أفعاله المخالفة للقانون، مؤكدا على أن مجموعة الصور ومقاطع الفيديو التي تم العثور عليها تعد دليلا ماديا ومعنويا قاطعا على الجرم المرتكب، كما أنها تشكل مساسا مباشرا بالهوية الوطنية، وشدد الوكيل على أن جميع التهم ثابتة في حق المتهم، مطالبة بتطبيق العقوبات التي ينص عليها القانون في مثل هذه القضايا، حفاظا على استقرار الوطن وأمنه.

He appeared calm, showing no signs of fatigue or health deterioration, contrary to the rumors spread by some parties. The man appeared to be in good health. There was no sign of confusion in his movement or his expressions; he looked perfectly normal, dressed simply, which reflected his physical comfort. This confirmed that he had not been mistreated or pressured during his detention. His humane treatment by the guards and the court staff further emphasized this.

🛑 In courtroom number 2 at the Algiers Court of First Instance, during a routine session for public order cases and related misdemeanors, Sansal was the fourth defendant to appear before the court, which confirmed that, like all other defendants, he was not given any preferential treatment or expedited process in terms of the trial.

... Just 20 minutes were enough for the Algerian judiciary to dispel the false claims and rumors that some enemies of Algeria tried to spread regarding supposed pressures and fabricated torture. Algeria, with its sovereignty and institutions, conducts trials through advocacy, not vengeance, and upholds the flag of justice above all else.

The judge called Boualem Sansal and asked him to approach the stand for questioning: "Are you ready for your trial? Where is your defense?"
Sansal responded: "I have decided to cancel my lawyer’s power of attorney, and I am ready to answer all the questions posed by the court."
The judge began the trial and confronted Sansal with the charges brought by the investigating judge. Sansal appeared calm and composed, listening attentively to the judge, though at times he had to move closer due to hearing difficulties. This interaction was evident throughout the session, with the accused stepping forward whenever he needed to hear the question clearly, while the judge dealt with him patiently, repeating some phrases to clarify the questions.

Despite the heavy charges he faced, Sansal did not attempt to evade answering, responding directly and clearly, speaking in a calm tone without agitation. The session proceeded smoothly, with no tension or altercations, as everything was conducted within a legal framework. The court did not impose any restrictions on him, reflecting the respect for legal procedures and ensuring the defendant's right to defend himself freely.

Sansal appeared comfortable, even showing some gestures that reflected his confidence in his statements. He did not hesitate to ask for clarification on certain questions due to language issues. Despite his refusal to appoint any lawyer to defend him, no pressure was applied, and he was allowed to express his viewpoint without interruption or restrictions by the court, which dealt with him professionally and with full respect for his rights as a defendant, giving him the opportunity to respond fully to all the charges against him.

The session continued in a normal atmosphere, with Sansal appearing aware of what was happening around him and engaging with the trial proceedings. He showed no signs of stress or anxiety, and thus, the trial unfolded with strict adherence to legal procedures, confirming that it was conducted fairly, giving the accused a complete opportunity to defend himself without obstacles or pressures.

Face to Face... The Judge Questions Sansal
Without delay, the judge began questioning Boualem Sansal.
Judge: "Do you speak Arabic?"
Sansal: "Honestly, I do not speak it well."
Judge: "What about 'Darija' (Algerian Arabic)? We will speak in Darija; try to respond as best you can in understanding the questions posed to you."
Accused: "I do not understand Darija either, Mr. President."
The judge then asks Sansal for his full name, confirming his identity, date of birth, and personal details before presenting the charges against him: "You are charged with offenses related to national unity, insulting a public authority, engaging in practices that harm national security and economy, and possessing videos that threaten national security. Do you acknowledge or deny these charges?"
Sansal: "No, Mr. President, I deny these charges in full."
Judge: "An electronic search of your devices, including your phone, revealed a message sent to someone named 'Yazid,' who is part of the 'MAK' movement. In it, you told him that you were happy with what the organization was doing to achieve independence and the separation of the Kabylie region. Did you send him this message, and what is your response to these facts?"
Sansal: "No, I did not send him that, Mr. President."
Judge: "There is another charge related to insulting a public authority, specifically the Algerian parliament, where messages between you and a member of the French embassy were found."
Sansal: "I don’t understand."
Judge: "There are WhatsApp messages between you and the current French ambassador, containing insults to the army and government institutions?"
Sansal: "Yes, I do not deny the existence of these messages, but they were just casual conversations and did not include any insults."
Judge: "Another question. According to the results of the electronic search, messages between you and the former French ambassador to Algeria were found, in which you expressed your happiness about the current situation in Algeria and said: 'I’m happy we have oil and Chengriha.' What did you mean by that?"
Sansal: "Yes, there were messages between us. We are friends, and I expressed to him the reality of Algeria’s financial and security situation, sharing my happiness with the stable security and financial situation in our country. There was no insult or mockery in those messages, and I had no ill intention behind them."
Judge: "What about the article found with you, which discusses Algeria’s military strength and army?"
Sansal: "I was expressing my opinion as an Algerian citizen, and I wrote the article to present my perspective without any intention to disrespect the army institution, which I deeply respect."
Judge: "There is another charge related to harming the national economy, based on messages retrieved from your phone and personal conversations with the former French ambassador, where you discussed Algeria’s refusal to join the BRICS organization twice."
Sansal: "These messages were just a conversation between me and the ambassador, as we share a friendship, not based on his position as a French diplomat."
Judge: "What is your response to the accusation of spreading false news that harms Algeria's security, through a TV interview in which you criticized the state’s decisions and institutions based on incorrect information and attributed baseless facts to them?"
Sansal: "The interview I later published on online platforms contained statements expressing my opinion and concerns as an Algerian citizen. I tried to convey the reality I live, like other Algerians. There was no intention to harm, of course."
Judge: "You are also accused of possessing documents and videos found on your flash drive, which threaten public order and national security. What do you say about that?"
Sansal: "Yes, I admit the presence of these files and videos, but I created them within the framework of freedom of expression, nothing more."

10 Years in Prison for Charges of Harming National Unity
In light of this, the public prosecutor at the Algiers Court of Misdemeanors requested a sentence of 10 years of prison and a fine of one million Algerian dinars for Boualem Sansal, on charges of harming national unity, insulting a public authority, engaging in practices that could harm the national economy, and possessing videos and publications threatening national security and stability.

In a strong argument, the public prosecutor confirmed that Boualem Sansal, a citizen holding Algerian nationality, had held an important government position in a sensitive ministry but became involved in statements and publications that undermine national unity and threaten the security and stability of the country.

The prosecutor delved into the details of his arrest at Houari Boumediene Airport upon entering Algeria with an Algerian passport, based on an arrest warrant issued against him, and his subsequent arrest at the Algerian airport.

The prosecutor revealed that electronic searches of the accused’s phone, computer, and storage media had uncovered files and videos, along with messages exchanged on WhatsApp, containing dangerous content that threatened national security. Investigations also revealed statements made by the defendant in which he undermined national territorial integrity.

Additionally, the prosecutor pointed out that the investigation showed messages exchanged between Sansal and members of the terrorist organization "MAK," in which he admitted his relationship with a person named "Yazid," a member of the organization, discussing the issue of the Kabylie region's independence and the group's plans to achieve this goal.

The prosecution accused the defendant of explicitly insulting public institutions in Algeria through several messages that contained false accusations, as well as spreading false ideas and claims.

Furthermore, the prosecutor highlighted that the defendant, who held a high position in one of Algeria's sensitive sectors, had sent messages in October criticizing the national economy, using phrases that aimed to question the performance of Algeria’s constitutional, civil, and military institutions.

The prosecutor concluded by emphasizing that, while the defendant enjoys the right to free expression, Algerian law and the constitution, along with the penal and procedural codes, set strict limits on the exercise of this right, which cannot be exceeded under any pretext.

There was no sign of confusion in his movement or his expressions; he looked perfectly normal, dressed simply, which reflected his physical comfort. This confirmed that he had not been mistreated or pressured during his detention. His humane treatment by the guards and the court staff further emphasized this.

🛑 In courtroom number 2 at the Algiers Court of First Instance, during a routine session for public order cases and related misdemeanors, Sansal was the fourth defendant to appear before the court, which confirmed that, like all other defendants, he was not given any preferential treatment or expedited process in terms of the trial.

... Just 20 minutes were enough for the Algerian judiciary to dispel the false claims and rumors that some enemies of Algeria tried to spread regarding supposed pressures and fabricated torture. Algeria, with its sovereignty and institutions, conducts trials through advocacy, not vengeance, and upholds the flag of justice above all else.

The judge called Boualem Sansal and asked him to approach the stand for questioning: "Are you ready for your trial? Where is your defense?"
Sansal responded: "I have decided to cancel my lawyer’s power of attorney, and I am ready to answer all the questions posed by the court."
The judge began the trial and confronted Sansal with the charges brought by the investigating judge. Face to Face... The Judge Questions Sansal
Without delay, the judge began questioning Boualem Sansal.
Judge: "Do you speak Arabic?"
Sansal: "Honestly, I do not speak it well."
Judge: "What about 'Darija' (Algerian Arabic)? We will speak in Darija; try to respond as best you can in understanding the questions posed to you."
Accused: "I do not understand Darija either, Mr. President."
The judge then asks Sansal for his full name, confirming his identity, date of birth, and personal details before presenting the charges against him: "You are charged with offenses related to national unity, insulting a public authority, engaging in practices that harm national security and economy, and possessing videos that threaten national security. Do you acknowledge or deny these charges?"
Sansal: "No, Mr. President, I deny these charges in full."
Judge: "An electronic search of your devices, including your phone, revealed a message sent to someone named 'Yazid,' who is part of the 'MAK' movement. In it, you told him that you were happy with what the organization was doing to achieve independence and the separation of the Kabylie region. Did you send him this message, and what is your response to these facts?"
Sansal: "No, I did not send him that, Mr. President."
Judge: "There is another charge related to insulting a public authority, specifically the Algerian parliament, where messages between you and a member of the French embassy were found."
Sansal: "I don’t understand."
Judge: "There are WhatsApp messages between you and the current French ambassador, containing insults to the army and government institutions?"
Sansal: "Yes, I do not deny the existence of these messages, but they were just casual conversations and did not include any insults."
Judge: "Another question. According to the results of the electronic search, messages between you and the former French ambassador to Algeria were found, in which you expressed your happiness about the current situation in Algeria and said: 'I’m happy we have oil and Chengriha.' What did you mean by that?"
Sansal: "Yes, there were messages between us. We are friends, and I expressed to him the reality of Algeria’s financial and security situation, sharing my happiness with the stable security and financial situation in our country. There was no insult or mockery in those messages, and I had no ill intention behind them."
Judge: "What about the article found with you, which discusses Algeria’s military strength and army?"
Sansal: "I was expressing my opinion as an Algerian citizen, and I wrote the article to present my perspective without any intention to disrespect the army institution, which I deeply respect."
Judge: "There is another charge related to harming the national economy, based on messages retrieved from your phone and personal conversations with the former French ambassador, where you discussed Algeria’s refusal to join the BRICS organization twice."
Sansal: "These messages were just a conversation between me and the ambassador, as we share a friendship, not based on his position as a French diplomat."
Judge: "What is your response to the accusation of spreading false news that harms Algeria's security, through a TV interview in which you criticized the state’s decisions and institutions based on incorrect information and attributed baseless facts to them?"
Sansal: "The interview I later published on online platforms contained statements expressing my opinion and concerns as an Algerian citizen. I tried to convey the reality I live, like other Algerians. There was no intention to harm, of course."
Judge: "You are also accused of possessing documents and videos found on your flash drive, which threaten public order and national security. What do you say about that?"
Sansal: "Yes, I admit the presence of these files and videos, but I created them within the framework of freedom of expression, nothing more."

10 Years in Prison for Charges of Harming National Unity
In light of this, the public prosecutor at the Algiers Court of Misdemeanors requested a sentence of 10 years of prison and a fine of one million Algerian dinars for Boualem Sansal, on charges of harming national unity, insulting a public authority, engaging in practices that could harm the national economy, and possessing videos and publications threatening national security and stability.

In a strong argument, the public prosecutor confirmed that Boualem Sansal, a citizen holding Algerian nationality, had held an important government position in a sensitive ministry but became involved in statements and publications that undermine national unity and threaten the security and stability of the country.

The prosecutor delved into the details of his arrest at Houari Boumediene Airport upon entering Algeria with an Algerian passport, based on an arrest warrant issued against him, and his subsequent arrest at the Algerian airport.

The prosecutor revealed that electronic searches of the accused’s phone, computer, and storage media had uncovered files and videos, along with messages exchanged on WhatsApp, containing dangerous content that threatened national security. Investigations also revealed statements made by the defendant in which he undermined national territorial integrity.

Additionally, the prosecutor pointed out that the investigation showed messages exchanged between Sansal and members of the terrorist organization "MAK," in which he admitted his relationship with a person named "Yazid," a member of the organization, discussing the issue of the Kabylie region's independence and the group's plans to achieve this goal.

The prosecution accused the defendant of explicitly insulting public institutions in Algeria through several messages that contained false accusations, as well as spreading false ideas and claims.

Furthermore, the prosecutor highlighted that the defendant, who held a high position in one of Algeria's sensitive sectors, had sent messages in October criticizing the national economy, using phrases that aimed to question the performance of Algeria’s constitutional, civil, and military institutions.

The prosecutor concluded by emphasizing that, while the defendant enjoys the right to free expression, Algerian law and the constitution, along with the penal and procedural codes, set strict limits on the exercise of this right, which cannot be exceeded under any pretext.
